India s Tobacco Advertising Ban The World Health Organization (WHO) reports that worldwide, five million tobacco users die annually and estimates that one million Indians die each year prematurely from tobacco use (2015). As late at 2009, India was ââ¬Å"the worldââ¬â¢s second-largest consumer and third-largest producer of tobaccoâ⬠(Economist, 2009, p. 5). In an attempt to reduce consumption, India introduced its first adverting ban on tobacco in 1990, followed in 2003 by the Cigarettes and Other Tobacco Products Act (COTPA) to close loopholes and further regulate tobacco adverting. This paper examines the arguments for and against these advertising bans and explores whether or not tobacco creates a conflict of interest when governments profit from the tobacco industry. For the Ban The most compelling reason to ban tobacco advertising is the growing body of evidence linking tobacco ads to increased tobacco use, particularly children. Studies following a 1998 settlement prohibiting U.S. tobacco companies from targeting American youth have shown a steady decline, with the lowest levels in forty years of teenage smoking reported in 2015. Despite COTPA, Indian youthââ¬â¢s exposure to cigarette advertising has increased in part because of aggressive point-of-sale marketing, promotional support of music and sporting events, through social media, and smoking portrayed in Bollywood films.
